Court Allows Eviction of Eric’s Adventure Tours Site at Bapor Kibra to Proceed

WILLEMSTAD – The eviction of the Eric’s Adventure Tours site at Bapor Kibra may move forward. The Court of First Instance of Curaçao ruled yesterday that the company’s objection to the imposed administrative enforcement was inadmissible, and therefore its request to halt the eviction has also been rejected.

The Minister of Traffic, Transportation and Spatial Planning issued an enforcement order earlier this year, arguing that Eric’s Adventure Tours had been using the land without authorization. The ministry also stated that structures were built on the site without permits. In addition, the area is designated in the Island Development Plan as a future road corridor.

According to the Court, the company did file a pro forma objection on time but failed to submit the required substantive grounds within the established deadline. That omission, although caused by the company’s attorney, is legally attributed to the company itself. The judge concluded that the minister was therefore justified in declaring the objection inadmissible.

As a result, both the enforcement decision and the order to vacate and demolish the structures remain in effect. The Court also rejected the company’s requests to temporarily suspend the enforcement, ruling that there is no basis for a provisional measure or stay of execution.

The ministry began preparatory work on the site earlier this week. With yesterday’s ruling, the eviction can now proceed without further legal obstacles. The company may still appeal the decision to the Joint Court of Justice.
