Court case PAR MP on August 7

Local | By Correspondent August 3, 2020

WILLEMSTAD - The summary proceedings filed by the member of the coalition party PAR, Shaheen Elhage in connection with his accession to parliament are on the role of the court for this Friday at 10:00 am. That is later than expected.

The date is fixed, says lawyer Michael Bonapart, who represents Elhage in this case. "Against this, there is not much we can do without the cooperation of the court and the defendants." Bonapart thinks that "the recess and the subpoena to all parties may have played a part in the choice for 7 August.

Shaheen Elhage, number 10 on the PAR electoral list, has filed a summary proceeding against the members of Parliament, the President of Parliament, Parliament as a whole and the Country. He demands that the judge in this urgent procedure order that all twenty sitting Members of Parliament cooperate in his accession to parliament.

As an intended Member of Parliament, Elhage has a direct interest in joining the Curaçao Parliament, as the petition for summary proceedings showed earlier. Because the ten opposition members in the parliament do not respond to the call for a public meeting that could therefore not be held three times because of a lack of quorum, 'a wrongful infringement' is committed on Elhage's' right to vote and the right to be a candidate and in particular from the voters who cast their votes for him. '

In summary proceedings, participation in the meeting must be enforced. By order of the judge, the parliamentarians of both the coalition and the opposition must cooperate in the treatment of Elhage's credentials in a meeting of Parliament.

This means that the vacant seat, which became vacant after the death of PAR member William Millerson last month, can be filled by his party colleague. Then the PAR faction is again complete with six members.
