Knops: “Entity does not take over legislation and regulations”

Local | By Correspondent August 28, 2020

WILLEMSTAD - The Caribbean Reform Entity Act (CHE) does not take over any powers in the field of legislation and regulations from Curaçao, Aruba, and Sint Maarten. The entity is only supportive and therefore does not conflict with the autonomy of these countries. Undersecretary Raymond Knops expresses himself in similar terms in response to questions from the Dutch Parliament.

According to Knops, this proposal aims to "establish cooperation between the Netherlands and each of the Caribbean countries without this fundamentally interfering with constitutional autonomy."

According to Knops, in a consensus kingdom law, it is possible to allocate powers to Dutch bodies, which can then have an effect and can be applied in the legal systems of the Caribbean countries. According to Knops' explanation, Article 38, second paragraph, of the Charter offers the scope for this.

The Undersecretary will come next week for a working visit to Curaçao.
