Owner of G&V International Fashions Happy Clothes sentenced for late filing income tax return

WILLEMSTAD - Last week the owner of G&V International Fashions Happy Clothes was sentenced by the court for a fine of NAf. 2,500.00 and a 40-hour suspended sentence.

The defendant was on trial for late filing of her income tax return for the years 2015 and 2016. This case is the first impetus to improve tax ethics in the country of Curaçao through the use of criminal law instruments.

Because over the years 2011 to 2013, she already had 3 administrative fines of a total of NAf. 3,000, it was decided in the tripartite (consultation between Tax Authorities, Tax Affairs Sector, Customs, and Public Prosecution Service) to prosecute as a last resort. Initially, the case was in session on April 12, 2019. Then the case was postponed because the suspect did not appear.

Last week Friday during the hearing, the accused denied having received the letters of formal notice from the tax authorities. But this position was rejected because she had signed to receive these letters.

She has waived her right to appeal.
