Reason why LB Construction BV exercised right of retention on Ritz Residence apartments

WILLEMSTAD - In a press release, Hans Robben, managing director of The Ritz Residence, explained why the construction company Lendering Bove Constructie BV (LB Construction BV) has exercised its right of retention on the construction of the apartments. 

According to Robben the reason for this action is the following:

LB Constructie has made a lot of construction errors over the past construction period (recorded by 2 independent inspection agencies) that have led to a significant delay in construction.

The construction contract provides for a construction discount (penalty) for late delivery, which has now risen to Nafl 287,875.- and Nafl 13,500.- is added every day.

LB refuses to pay it or to provide security for it. 

Robben says that as a result, The Ritz has had to take legal action as well as stop payments as additional security for its claims against LB. 

Robben: “All apartments were already sold in February of this year. I am obliged to the buyers of the apartments to ensure the quality delivered. If that is not good enough, the work has to be done again and that takes time. LB has the delay entirely to himself and must now be on the blisters.”

 

“Exercising the right of retention and placing the signs is just a show of power from a clumsy contractor but does not remove the cause of the problem (lack of quality),” says Robben in his press release.
