WILLEMSTAD - The Ministry of Traffic, Transport and Urban Planning (VVRP), has provided additional information regarding two recent court cases involving ATV tour operators.
In the first case, the court ruled that the lawsuit filed by an ATV tour operator against the government was inadmissible. As a result, the party involved has been ordered to cover the legal costs of the proceedings.
In the second case, the Joint Court of Justice also declared the appeal inadmissible. This ruling means that the decisions previously taken by the ministry remain valid and enforceable.
With these two rulings, the ministry notes that it has now prevailed for the fifth consecutive time in legal proceedings related to the regulation of ATV tours. According to VVRP, the outcome confirms that ATV tour operators will be required to remove their establishments from the designated locations, in line with the original orders issued by the Projectteam Toezicht en Handhaving (PTH).
The ministry stated that it has taken note of the court decisions and will continue to act in a fair, transparent and lawful manner, always with the interests of the community as its guiding principle.
