WILLEMSTAD - The Court upheld the Oostpunt (east point) revision. This decision makes it possible to develop the Oostpunt area.
Several conservation organizations, including Carmabi, Fundashon Pro Monumento (ProMo), and Fundashon Defensa Ambiental (FDA), have appealed the Oostpunt review. They fear the developments will irreparably affect nature, the environment, and cultural-historical values in the Oostpunt area.
The Court now rules that the revision does not violate fundamental rights, the Biodiversity Convention, or the Sea Turtle Convention. The Court also does not consider the possibility of an objection procedure against a national ordinance appropriate.
The development will have to occur within the limits of the national law of Curaçao and international environmental law. It is crucial that nature, the environment, and any cultural-historical values in the area are taken into account. An environmental impact assessment is an important part of this.
