National Ordinance Real Estate Tax 2014 amended from 1 September 2019

Persons who have not received a property tax assessment must report this to the Tax Inspectorate before 1 March 2020

WILLEMSTAD - The Minister of Finance would like to remind everyone that the National Real Estate Property Tax Regulation 2014 (OZB) was amended with effect from 1 September 2019. We refer to P.B. 2019, no. 55.

This article is aimed at making this change known again to owners and other persons entitled to immovable property and to inform these persons on time, also in view of the fine included in the national ordinance, so that they can take appropriate action before 1 March 2020.

Persons who own an immovable property in Curaçao or who can make use of an immovable property by virtue of possession or a limited right (for example usufruct or economic ownership) are subject to the property tax. The property tax must be paid if an assessment is imposed. The Tax Inspectorate does not always have the correct information to impose an assessment. That is why last year it was included in the National Ordinance on property tax 2014 that persons who have not received a property tax assessment must submit a declaration to the Tax Inspectorate. Two different situations can be distinguished:

A one-off catch-up action in which taxpayers must make a declaration if they have not received a property tax assessment in the past 5 years. If you have not received an assessment for any of the years 2014-2018, this must be reported to the Tax Inspectorate before 1 March 2020.

An annual obligation to indicate that no assessment has been received for the previous year. This means, for example, that if no tax assessment was received in 2019 for the year 2018, the taxpayer must report this to the Tax Inspectorate before 1 March 2020.

The declaration can be made by means of a letter addressed to the Tax Inspectorate, real estate tax department, which at least states the name, address and Crib (tax) number of the taxpayer; the date of acquisition of the immovable property; the address of the property; under which law immovable property is registered and an indication must also be given of the value of the immovable property. The letter can be issued at the World Trade Center Curaçao in Piscaderaweg or can be sent by e-mail to onroerendezaakbelasting@gobiernu.cw.

Persons who do not comply with the obligation to declare will be fined 100% of the amount due.
